Public Notaries Act 1997 – Schedule 1 – Clause 8 – General Saving
This “general saving” provision of the Fist Schedule, contained in clause 8, can be compared to the more specific provisions of clause 4. Under the general clause 8, any acts commenced under the old repealed scheme (being acts commenced under the Public Notaries Act 1985) will have valid legal effect and will be seen to their logical conclusion under the provisions of that old repealed scheme. The specific terms of clause 8 are stated as follows:
(1) If anything done or commenced under a provision of the repealed Act before the repeal of that provision and still having effect or not completed immediately before that repeal could have been done or commenced under this Act if this Act had been in force when the thing was done or commenced:
(a) the thing continues to have effect, or
(b) the thing commenced may be completed.
(2) This clause is subject to any express provision of this Act on the matter.
